Kangaroo Field Trial Terms and Conditions

You agree that you are an Amica policyholder. Amica, Kangaroo, and/or partnering companies will provide the Water and Climate Sensor (the “Device”), as well as access to any associated data/services mobile application, or you will download the applicable mobile application (collectively, “Platform”).

You may be asked to provide personal information (name, address, phone number, etc.) in order to use the Device and/or the Platform. You acknowledge that Amica, Kangaroo, and/or partnering companies will collect and analyze data on behalf of yourself and Amica. This data will be used for the purpose of learning and discovery by Amica, Kangaroo or partnering companies. Amica, Kangaroo and/or partnering companies will have unconditional use of the data collected during the Field Trial, royalty free and into perpetuity. Security controls regarding the storage and transfer of data will be evaluated commiserate with the sensitivity of the data. Amica, Kangaroo or partnering companies will do their best to preserve the privacy of the data produced during the Field Trial. By installing the Device in your home and/or downloading the Platform, you agree that Amica, Kangaroo or partnering companies may have access to view data collected by the Device and/or the Platform.

You will contact Amica, Kangaroo and/or partnering companies if any issues arise concerning the installed Device and/or the Platform. You release and discharge Amica from any and all claims arising out of use of the Device and/or the Platform for the purposes described above.

These terms and conditions shall remain in effect throughout the Field Trial or until terminated by you or Amica. Should you need to terminate your participation in the Field Trial, please contact "KangarooTrial@amica.com”. Amica may, in its sole discretion, suspend or terminate the Field Trial with or without prior notice. These terms and conditions will terminate immediately, without prior notice from Amica, in the event that you fail to comply with any provision herein.

You further agree to maintain confidentiality regarding the Device and/or the Platform and not disclose any information about the Device and/or the Platform without consent from Amica unless information regarding the Device and/or the Platform is otherwise publicly available. You also agree you will not tamper, disassemble, modify, destroy, or otherwise interfere with the Device or the Platform during the duration of the Field Trial. You further agree not to, and you will not permit others to, license, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose or otherwise commercially exploit the Device and/or the Platform or make the Device and/or the Platform available to any third party. No warranties will be provided for the duration of the Field Trial.

Amica, Kangaroo or partnering companies and other third parties are not liable for any damages that may occur during this Field Trial for any reason including but not limited to failure of the device and any potential claim. Any loss that may occur will be subject to your policy in effect at the time of this Field Trial. You agree to indemnify Amica, Kangaroo or partnering companies and other third parties should damage occur.

You agree that you will not assert or maintain against Amica any claim, action, suit or demand of any kind or nature whatsoever, for any reason in connection with the installation and your use of the Device and/or the Platform as herein provided. You hereby release Amica, its successors, assigns and licensees, and each of them, from and against any and all claims, liabilities, demands, actions, causes of action(s), costs and expenses whatsoever, at law or in equity, known or unknown, anticipated or unanticipated, which you ever had, now have, or may, or shall hereafter have by reason, matter, cause or thing arising out of their use of the data collected as herein provided.

If any term or condition herein is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect. Amica reserves the right, at its sole discretion, to modify or replace these terms and conditions at any time.
